At its meeting on 26 April 2023, Armidale Regional Council resolved to seek feedback on the draft Conflict of Interest Policy for Council Related Development Applications. The purpose of this draft Policy is to manage potential conflicts of interest and increase transparency at all stages of the development process for council-related development.

Background:

Sometimes Council is required to prepare and lodge development applications to obtain consent to carry out development on land it owns, occupies or otherwise controls. An inherent conflict of interest therefore arises as the development application is being made to itself for determination as the consent authority under the EP & A Act 1979.

To ensure the planning system remains transparent and accountable, the NSW Government recently implemented changes to the Regulations to require Council to:

• Have a Policy that sets out how they will manage any potential conflicts of interest that may arise in relation to council-related development,

• Consider this Policy before determining any development applications that are council-related &

• Publicly communicate any management approaches that the Council will implement (if any) for each development.

The draft Policy has been prepared to ensure consistency with the model template and the Council related Development Application Conflict of Interest Guidelines prepared and provided by the NSW Department of Planning and Environment (DPIE).

Submissions are invited and must be addressed to the General Manager, Armidale Regional Council, PO Box 75A, Armidale, NSW 2350, or sent by email to council@armidale.nsw.gov.au.

Submissions must be received by Council no later than 5.00 pm on Thursday, 25 May 2023.

Please be aware that if you make a submission, other people may have access to your comments. This may be as a result of a report to a Council meeting or as part of an application under the Government Information (Public Access) Act 2009. Also, under State legislation, any person making a submission on a Draft LEP amendment must also disclose whether they or an ‘associate’ have made a ‘reportable political donation’ or gift to a local Councillor or Council employee within the period commencing two years before any submission is made and ending when the Draft LEP is determined. Further details including disclosure forms are available on request from Council.
