Exhibition of Review of Local Approval Policy Street Trading ARC16/1132

Council, at its meeting held on 26 October 2022 endorsed the Local Approval Policy Street Trading (LAP) which has previously been the subject of extensive community consultation. This is a review which is mandated to occur within 12 months after the local government election. It is now to be placed on public exhibition for a period not less than 28 days. Accordingly Council has prepared a document for you to download and view, and is inviting submissions on the Policy before being reported back to Council.

Background:

The Local Approvals Policy Street Trading (LAP) is a local policy for Council which requires approval for certain activities under the Local Government Act 1993 (the Act).

The LAP enables street trading to be undertaken in the majority of case without the need for approval from Council. Should a business owner not be able to comply with the exemptions an application is required which will be considered on its merits.

Examples of street trading included in the LAP are:

 Sale of newspapers from a stand on a footpath.

 Sale of food and drinks from a stall, standing vehicle or kiosk in a pedestrian mall

 Sale of articles from stalls or tables on a footpath, including those operated by

charitable organisations.

 Setting up of outdoor eating areas or take-away facilities in a pedestrian area.

 Placing an advertising sign on a footpath in front of a shop.

 Sale of articles from a standing vehicle on the side of a carriageway.

 Sale of ice-cream or sweets from a vehicle on public streets, making brief intermittent

stops.

The LAP also includes controls for the following structures or items that are placed on footpaths

and are frequently ancillary to street trading activities:

 Screens.

 Planter boxes.

 Shade structures or items.

 Gas heaters (outdoor radiant heaters).

Feedback:

The Policy will be on public exhibition from 7 February 2023 until close of business on 28 March 2023.

Submissions are invited and must be submitted to Council no later than 5.00 pm on Tuesday 28 March 2023.

Submissions must be addressed to the General Manager, Armidale Regional Council.

  • Written submissions are accepted over the counter at either of Council’s offices at; 135 Rusden Street, Armidale, NSW, 2350; or 158 Bradley Street, Guyra, NSW, 2365 (office hours are 10am-4pm).
  • Written submissions are also acceptable via post. Mail must be addressed to PO Box 75A, Armidale, NSW 2350.
  • Electronic submissions are preferred and should be sent via Email to council@armidale.nsw.gov.au
