Notice to reclassify land - Fairview Estate
At the Ordinary Council Meeting held on Wednesday 26 March 2025, Council endorsed the recommendation that the the recently purchased 6 Elaine Close, Black Mountain, be placed on public exhibition for a period of 28 days from Thursday 27 March to Sunday 27 April 2025 with the proposal to classify it as Operational Land.
RESOLVED
That Council:
a. Place the recently purchased at 6 Elaine Close, Black Mountain, on public exhibition for a period of 28 days with the proposal to classify it as Operational Land
b. Adopt the classification as Operational Land should no submissions be received
BACKGROUND
Fairview Estate subdivision was approved by the then Guyra Shire Council in January 2014. Construction of the subdivision was completed, and the infrastructure handed over to the Council in 2016. Since this time, the lots have been sold and some houses have been built.
Unfortunately, Fairview Estate has historical drainage issues which Armidale Regional Council (ARC) are now rectifying as part of the Fairview Estate Drainage project in the Operational Plan.
Number 6 Elaine Close was purchased in January 2025 under council resolution 202/24 for the purpose of facilitating construction of the drainage upgrade works in Fairview Estate and formalising an easement over the property prior to resale. The property purchase and subsequent resale is aimed at reducing the impact to existing landowners, limit the extent of works and avoid potential compensation payable by council to the affected landowners.
However, before works can commence, the land is required to be classified as Operational Land.
